These Terms of Service ("Terms") govern your purchase and use of Dirt Road Poker (the "Product") at dirtroadpoker.com and play.dirtroadpoker.com, operated by Dirt Road Poker (the "Company," "we," "us"). By purchasing or accessing the Product, you agree to these Terms. If you do not agree, do not purchase or use the Product.
Dirt Road Poker is a digital product: an illustrated guide to 54 original card games, delivered as an online interactive rules site plus a downloadable PDF. Access is granted immediately after payment. The Product is intended for personal entertainment only.
The Product is a one-time purchase of $9.99 USD (unless a different price or discount is shown at checkout). Payment is processed securely by Stripe; you authorize the charge shown at checkout.
Because the Product is digital and access is delivered instantly, all sales are final. If you cannot access what you paid for or were charged in error, email info@dirtroadpoker.com within 14 days and we will make it right, including a refund where appropriate, at our reasonable discretion. Where you have a non-waivable statutory right to withdraw (e.g., certain EU/UK consumers), by accessing the digital content immediately you acknowledge and agree that this right ceases once access has begun.
We may suspend or revoke access at any time if a purchase is refunded, charged back, or disputed, or if you violate these Terms.
All content, game designs, text, and artwork in the Product are owned by the Company and its licensors and are protected by intellectual-property laws. The "Dirt Road Poker" name and branding may not be used without our written permission.
You use the product at your own risk. The games and guide are provided for entertainment purposes only and are not professional, gambling, financial, or other advice.
The product is provided "as is" and "as available," without warranties of any kind, whether express, implied, or statutory. To the fullest extent permitted by law, the company disclaims all implied warranties, including merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the product will be uninterrupted, timely, secure, or error-free, or that any content is accurate or complete.
To the fullest extent permitted by applicable law, in no event will the company, its owners, affiliates, officers, employees, or suppliers be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or other intangible losses, arising out of or relating to the product or these terms, whether based in contract, tort, negligence, strict liability, or otherwise, and even if advised of the possibility of such damages.
The company's total aggregate liability for any and all claims arising out of or relating to the product or these terms will not exceed the greater of (a) the amount you actually paid for the product or (b) USD $10.00. Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.
You agree to indemnify, defend, and hold harmless the Company and its owners, affiliates, and suppliers from and against any claims, damages, liabilities, losses, and expenses (including reasonable attorneys' fees) arising out of or related to your misuse of the Product, your violation of these Terms, or your violation of any law or third-party right.
These Terms are governed by the laws of the State of Florida and applicable United States federal law, without regard to conflict-of-laws principles. You consent to the exclusive jurisdiction and venue of the state and federal courts located in Florida.
We may update these Terms; the "Effective" date shows the latest version. Continued use after changes means you accept them.
